O ministro do Tribunal Superior Eleitoral, Henrique Neves, negou nesta semana um pedido do Ministério Público Eleitoral para retirar do ar um blog em favor de Dilma Rousseff (PT) do ar argumentando que manifestações de apoio, "ainda que expressas, ou revelações de desejo pessoal que determinado candidato seja eleito, bem como as críticas ácidas que não transbordem para a ofensa pessoal, quando emanadas de pessoas naturais que debatem política na internet, não devem ser consideradas como propaganda eleitoral"

Com base nessa afirmação, o ministro do Tribunal Superior Eleitoral, Henrique Neves, negou nesta semana um pedido do Ministério Público Eleitoral para retirar do ar um blog em favor de Dilma Rousseff (PT) do ar.

O ministro, relator do caso, disse em seu voto que "diante de alegação da prática de L propaganda irregular, de um lado, não pode ser sacrificado o direito à livre expressão do pensamento do cidadão que se identifica, de outro, não é possível permitir que essa manifestação ofenda princípios constitucionais de igual relevância ou afronte as leis vigentes".

Trata-se de um importante passo à frente na interpretação da legislação eleitoral aplicada ao uso da internet. O tribunal define a diferença entre a livre circulação de ideias e a propaganda eleitoral.

E lança uma luz para que a internet possa ser usada como meio saudável de informação no processo eleitoral, sem os temores de que tudo que cai na rede é proibido.

O pedido do MPE foi negado porque Neves considerou que suspender todo o conteúdo do blog implicaria em determinar a retirada não só daquelas informações que, eventualmente, infrinjam a legislação, mas também todas as demais que constituem meras opiniões e estão abarcadas pela garantia da livre expressão do pensamento.

OS ARGUMENTOS
O MPE ajuizou o recurso contra o Google do Brasil por considerar que a empresa hospeda site no qual não se podem identificar os responsáveis por seu conteúdo. E argumentou que o site deveria ser retirado imediatamente do ar, a fim de que a disputa eleitoral “obedeça aos ditames de equilíbrio entre os candidatos”, uma vez que a propaganda eleitoral só é permitida após o dia 5 de julho.

Inicialmente, o ministro Henrique Neves, relator do caso, solicitou informações ao Google, que forneceu alguns dados sobre o responsável pela criação e manutenção do blog. Além disso, a empresa alegou que para remover o conteúdo eleitoral de suas ferramentas é imprescindível a apreciação prévia pelo Judiciário, “para que seja verificado se há ou não conteúdo lesivo, na forma da legislação vigente”.

Henrique Neves disse que a criminalização do debate político deve ser evitada. Para o relator, uma pessoa que não seja candidata ou que não aja a mando de um, somente pratica propaganda irregular quando esta se configura de forma abusiva, clara e evidente.
