Acabou a Copa da África e não adianta lamentar, chorar, dizer que era possível ter impedido a vitória da Seleção da Holanda que, após perder por 1 a 0 no primeiro tempo, virou o jogo e mandou a Seleção Brasileira de volta para casa por 2 a 1.

Nenhum brasileiro – exceto os donos de bares – ganhou ou perdeu nada com essa derrota. Há a dor da frustração etc., mas isso passa logo. O verdadeiro jogo, o que modifica a vida de todos, começa agora, com a aceleração da campanha eleitoral e o caso das Fichas Limpas.

A Ficha Limpa é uma das mais sórdidas leis já criadas no Brasil e os quase dois milhões de alienados cidadãos que a propuseram não pensaram que ela é um insulto a todos os brasileiros: é uma lei que diz que não sabemos votar, que elegemos criminosos e que é preciso que os juízes decidam por nós em quem devemos votar.

Essa lei confirma o que o Pelé dizia, que os brasileiros não sabem votar. A Lei da Ficha Limpa não está moralizando nem candidatos nem eleitores.

O que precisa ser feito é um rearmamento moral do Brasil através dos livres debates, onde todos pudessem mostrar a podridão e o crime escondidos em inúmeras candidaturas.

Somente a livre informação, sem a antidemocrática interferência da Justiça, libertará o Brasil da corrupção. Mas, aparentemente, há juízes que não querem isso, pois impedem o livre debate.

Não é preciso discutir se a Lei da Ficha Limpa vale para este ou aquele caso, se tem efeito suspensivo, se é anticonstitucional (e é mesmo e por isso não tem valor). Devemos meditar se vamos votar nos mesmos criminosos que estão aí pedindo votos ou decidir, de livre consciência, se devemos ao menos votar em alguém realmente honesto entre os candidatos (e eles existem.)

Ou se, mesmo escolhendo os que sabemos que são honestos, deveremos mais uma vez coonestar (dar validade) a uma antidemocrática campanha eleitoral, plena de candidatos amorais que não podemos denunciar pela proibição dos debates e das restrições à informação, e pelo “nivelamento” por baixo dos cidadãos.

Efetivamente, todos os cidadãos são iguais perante a lei, mas desiguais em propósitos e serviços à sociedade. Uma desigualdade social e intelectual de que se valem os mercenários e bandidos eleitorais para corromper o pleito.

Essa corrupção de candidatos e a Lei da Ficha Limpa para dizer quem pode ser eleito são decorrentes de liberdades civis cerceadas. Por isso não votei no abaixo-assinado da Lei da Ficha Limpa;

Ela não é eficaz contra a corrupção eleitoral, viola o princípio da presunção de inocência e pune (qualquer outra palavra é sinônimo) alguns com o pior dos castigos que se pode infligir a um político: a suspensão de seu mais elementar direito político, que é o de votar e ser votado.

Quero deixar claro que não estou defendendo os Fichas Sujas, e que para mim são todos os autores dos delitos relacionados pela Lei da Ficha Lima e não votarei em nenhum dos que os cometeram.

Simone Schreiber, juíza federal do Rio de Janeiro, professora de Direito Processual Penal da Universidade Federal do Estado do Rio de Janeiro (UNIRIO), em um ensaio sobre “O princípio da presunção de inocência”, diz que na prática judiciária brasileira não se estabeleceu diferença entre os princípios da presunção de inocência e da desconsideração prévia de culpabilidade.

“O exame da jurisprudência de nossos tribunais superiores demonstra que nunca se pôs tal diferença como fundamento para restringir o campo de aplicação do princípio da presunção de inocência. Mais do que isso: as expressões presunção de inocência e presunção de não culpabilidade são utilizadas como se fossem sinônimos.”

O importante é que cada eleitor continue a indagar sobre o passado do candidato ainda que a Lei da Ficha Limpa diga que é elegível. E decida de acordo com sua própria ética. É uma questão moral.

Por exemplo, ainda que a Lei da Ficha Lima, ou os tribunais, digam que o senador cassado por corrupção Expedito Júnior e elegível, eu não votarei nele por ter minha convicção pessoal de que é uma indecência a eleição de um homem que compra votos.

Mesmo que a Lei da Ficha Lima me diga que o senador Valdir Raupp não é alcançado por ela porque ainda não foi julgado por tribunal colegiado, não voto nele porque conheço seus crimes contra Rondônia.

A lei da Ficha Limpa tem efeito suspensivo? Quer dizer que autores de práticas hediondas como a pedofilia, e que ainda não foram presos ou julgados porque a Justiça Brasileira é muito vulnerável a advogados bem pagos, ainda podem ser eleitos?

Para encerrar, um repto ao Judiciário: quando terá coragem de proibir as pesquisas de intenção de votos que, na prática, por uma característica da psicologia popular brasileira deixam de se tornar informação para assumir o papel da Justiça Eleitoral na definição dos eleitos? Tais pesquisas tornam-se acima de todas as leis.

As “pesquisas de intenção de votos” que podem ser válidas e honestas em outros países, como mera informação, modificam a vontade do eleitor no Brasil.

Elas elegem os políticos por antecipação, porque determinam quem deve vencer. E não adianta tentar regulamentá-las. Mesmo que algumas absolutamente idôneas sejam encontradas, o mal já está enraizado.
